DMCA / Takedown Procedure

Last updated: September 2026

1. Our commitment to intellectual property

Above the Slush allows users to upload manuscripts for AI analysis. We respect intellectual property rights and take copyright infringement seriously. We comply with the Digital Millennium Copyright Act (DMCA) and respond promptly to valid takedown notices.

Manuscripts uploaded by users are stored securely and are not shared publicly — they are used only for AI analysis within your account. They are not accessible to other users, literary agents, publishers, or any third party.

2. How to submit a DMCA takedown notice

To submit a DMCA takedown notice, send an email to support@abovetheslush.com with the subject line "DMCA Takedown Request".

A valid DMCA takedown notice must include all of the following elements:

  1. Identification of the copyrighted work — a description of the copyrighted work you claim has been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material and its location — a description of the material you claim is infringing and the URL or other specific location on Above the Slush where it can be found, with sufficient detail for us to locate it.
  3. Your contact information — your name, mailing address, telephone number, and email address.
  4. Statement of good faith belief — a statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Statement of accuracy under penalty of perjury — a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
  6. Your physical or electronic signature — a physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

3. Our response

We will respond to valid DMCA takedown notices within 5 business days. Upon receiving a verified claim, we will promptly remove or disable access to the allegedly infringing content and notify the user who uploaded or posted it.

Notices that are incomplete, inaccurate, or do not comply with DMCA requirements may not be acted upon. We reserve the right to request additional information to verify the validity of a claim.

4. Counter-notice procedure

If you believe that content you posted was removed in error — for example, because you have authorization to use the material or because the takedown notice was mistaken — you may submit a counter-notice to support@abovetheslush.com with the subject line "DMCA Counter-Notice".

A valid counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and its location before removal.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  4. Your name, address, telephone number, and a statement consenting to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the US, any judicial district in which Above the Slush may be found).

Upon receipt of a valid counter-notice, we will forward it to the original complainant and may restore the removed content within 10–14 business days unless the complainant notifies us that they have filed a court action to restrain the activity.

5. Repeat infringer policy

Above the Slush has a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. Accounts with multiple verified DMCA claims against them will be suspended or permanently terminated at our sole discretion.
